The Energy Regulatory Commission (ERC) Chairperson Eng Emma Kiilu has given Cofek 24 hours to apologize and stop writing and or distributing any “defamatory” material against her lest will sue for defamation.
In her August 1 letter received at Cofek on August 6, the ERC boss vehemently denies ever having applied for the Director General’s (DG) job.
She also dismisses claims that a leading audit firm had been hired to recruit the DG. She instead quotes Section 12(1) of the Energy Act to appear to say that competitive hiring of the DG position as envisaged under Article 232 of the Constitution of Kenya 2010is not mandatory as long as the ERC board makes a “recommendation” on the best candidate to the Cabinet Secretary for Energy and Petroleum.

“At no time did either the CAJ or Cofek indicate she was guilty of the allegation. Cofek will, therefore, be more than pleased to meet Eng Kiilu in Court as a public servant and as an individual. We regret we have no apology for her”, said Mr Stephen Mutoro, Secretary General.
